Cyber security legal advice covers the legal and contractual side of protecting your business from cyber threats, rather than the technical side. It includes drafting cyber security and information security policies, reviewing contracts with suppliers and hosting providers, advising on which laws and regulations apply to your business, and preparing an incident response plan. It sits alongside, but is distinct from, GDPR compliance advice and data breach response, which cover different stages of the same risk.

GDPR compliance is about your ongoing legal obligations for handling personal data, such as lawful basis, retention and individual rights. Cyber security legal advice is broader and covers the policies, contracts and training that reduce the risk of an incident happening in the first place, some of which overlaps with GDPR but much of which does not, such as supplier contract terms or staff device policies that have nothing to do with personal data specifically.

There is no fixed size threshold. If your business handles customer data, staff records or payment information, a cyber security policy helps you set clear expectations for staff and demonstrate you took reasonable steps if something goes wrong. Many smaller businesses assume policies are only for larger organisations, but insurers, larger customers and regulators increasingly expect to see one in place, whatever your size.

A cyber security policy should cover how staff handle data and devices, password and access requirements, use of personal devices for work, reporting a suspected incident, and who is responsible for what if something goes wrong. It should be specific enough to guide staff behaviour rather than a generic document copied from elsewhere and reviewed regularly as your systems and risks change.

It reduces the risk rather than eliminating it entirely. Clear policies, properly drafted supplier contracts and trained staff close off many of the routes an incident typically starts from, such as phishing, weak access controls or an unclear line of responsibility. No business can guarantee a breach will never happen, but the legal groundwork narrows the chances and limits the damage if one does.

There is no legal requirement to use a solicitor, but cyber security policies and contracts often need to reflect specific legal obligations correctly to be worth relying on if something goes wrong.
