A statutory demand is a formal written notice requiring a debtor to pay an outstanding debt within a set period, typically 21 days, or face the risk of insolvency proceedings. It carries more legal weight than an ordinary reminder letter, since ignoring it can be used as evidence the debtor is unable to pay their debts. For businesses, an unanswered statutory demand can be grounds for a winding up petition. It's a serious step, so it needs to be used at the right point in the process, not as a first resort.

It depends on the size of the debt against the time, cost and effort involved in recovering it. As a general guide, very small debts, often under a few hundred pounds, may not be worth formal legal action once court fees and time are factored in, though a well timed letter before action can still prompt payment without needing to go further. Larger debts, or debts from a debtor who's simply avoiding payment rather than genuinely unable to pay, are usually worth pursuing formally. We assess this with you before you commit to any costs.

A judgment on its own doesn't guarantee payment, it simply confirms the debt is legally owed and enforceable. If the debtor still doesn't pay, enforcement options include instructing bailiffs or High Court Enforcement Officers to seize goods, applying for a third party debt order to recover funds directly from the debtor's bank account, or an attachment of earnings order if the debtor is an individual. A County Court judgment remains enforceable for up to six years, so there's time to act even if the debtor's circumstances change.

Insolvency action, such as a winding up petition against a company or bankruptcy proceedings against an individual, generally becomes a realistic option once an undisputed debt exceeds £5,000. It's a serious step that puts significant pressure on a debtor, since it threatens their ability to keep trading or manage their finances, but it should be used carefully and only where the debt is genuinely undisputed. A letter before action is an informal warning that sets out the debt and gives the debtor a chance to pay before court proceedings begin. A statutory demand is a more formal step with a specific legal effect, an unanswered statutory demand can itself be used as evidence of a debtor's inability to pay, which can support insolvency proceedings. Under the Late Payment of Commercial Debts (Interest) Act 1998, UK businesses are entitled to charge statutory interest, currently 8% above the Bank of England base rate, on overdue invoices, plus a fixed compensation amount for recovery costs.
