Many clients also review their wider estate plan at the same time, to make sure their LPA, will and any trusts all work together rather than in isolation.

Power Of Attorney FAQs

A Lasting Power of Attorney (LPA) is a legal document that lets you appoint someone you trust, known as your attorney, to make decisions on your behalf if you’re ever unable to make them yourself. There are two types, one covering property and financial affairs, and one covering health and welfare. An LPA must be registered with the Office of the Public Guardian before your attorney can use it, and our power of attorney solicitors in Manchester handle this registration for you.

The Office of the Public Guardian charges a registration fee of £92 for each LPA, so £184 if you register both types, with reductions available for people on a low income or certain benefits. Our fees for preparing and registering the documents are separate and agreed with you upfront on a Fixed Fee basis, so you know the total cost before any work begins.

A Property and Financial Affairs LPA covers decisions about money, bills, investments and property, and can be used with your consent even while you still have capacity. A Health and Welfare LPA covers decisions about your medical treatment, care and where you live, and can only be used once you’ve lost the capacity to decide these things yourself. Many people choose to set up both so every area is covered.

Yes, an Enduring Power of Attorney made before 1 October 2007 remains valid, but no new EPAs can be created today, only Lasting Powers of Attorney. If you hold an older EPA and it needs to be used because you’re losing capacity, it must be registered with the Office of the Public Guardian first. Since an EPA only covers property and financial affairs, you may also want a Health and Welfare LPA to cover the areas it doesn’t.

There’s a minimum four week waiting period built into the registration process, to allow anyone named on the LPA to raise concerns, and current Office of the Public Guardian processing times often run well beyond that, so it’s worth allowing several months from submission to receiving a registered LPA. Errors on the forms are a common cause of delay, which is one reason to have a solicitor prepare and check the documents before they’re submitted.

It isn’t a legal requirement, but an LPA is an important legal document, and mistakes on the forms are a common reason applications get rejected by the Office of the Public Guardian, sending you back to the start of a lengthy queue. A solicitor makes sure the right type is chosen for your circumstances, that the document reflects your genuine wishes, and that it’s valid and ready to use when it’s actually needed.

If you lose mental capacity without a registered LPA, your family can’t simply step in to manage your finances or make care decisions on your behalf, even if they’re your spouse or closest relative. Instead, they’d need to apply to the Court of Protection for a deputyship order, a process that’s slower, more expensive and more heavily supervised than setting up an LPA in advance would have been. This is why it’s worth arranging a power of attorney in Manchester while you’re still able to.
